Missing county emails are not enough to dismiss the criminal case against Mendocino County’s Auditor and Payroll Manager, according to Traci Carrillo, an outside prosecutor hired by DA David Eyster. Carillo says even if missing emails were critical to the case, there is no evidence of denial of due process on the part of the county. Defense Attorney Chris Andrian stated the cost of prosecuting the case is already proving more costly than the just over $68,000 in extra pay that Payroll Manager Kennedy received. Superior Court Judge Ann Moorman will hear arguments in the defense’s request to dismiss the case on the 13th.
