The Ukiah Police Department has been ordered to settle in the federal lawsuit brought on behalf of a mental disturbed man who was arrested in a controversial fashion last Spring. Gerardo Magdaleno, who is schizophrenic and suffers from bi-polar disorder was in the middle of a mental health crisis when officers employed extreme use of force to subdue him. Magdaleno was arrested but never charged for resisting arrest. The department was ordered to pay $211,000 in damages to Magdaleno. The Ukiah Police Department after an independent investigation was found to have operated within the department’s use of force guidelines. Police Chief Noble Waidelich, said in a press release that regardless of the investigation’s findings, this incident “warrants reflection.” He also notes that the UPD is actively engaged in a pilot program in which a mobile crisis worker responds to calls for service that might have a mental health component. The press release does not mention the lawsuit or the settlement.
